Terms of Use

These Terms of Use (“Terms”) constitute a legally binding agreement between you (“User”, “you”) and Kreatifart – Can Demirel (“LangoAI”, “we”, “us”, “our”), a company incorporated under the laws of Turkey.

These Terms govern your use of all LangoAI products and services, including:

By downloading, installing, or using any LangoAI product, you agree to be bound by these Terms. Platform-specific terms in Sections 4, 5, and 6 apply in addition to the general terms.

2. Acceptance of Terms

By accessing or using any LangoAI product, you confirm that you:

• Are at least 13 years of age (or the minimum age required in your jurisdiction)
• Have read, understood, and agree to these Terms
• Consent to our Privacy Policy
• Agree to any applicable platform terms (Apple, Adobe, or WordPress.org)

If you are using LangoAI on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. General License Grant

Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to use the applicable LangoAI product solely for your internal business or personal purposes.

You may NOT:

• Copy, modify, adapt, or create derivative works of any LangoAI product
• Reverse engineer, decompile, or disassemble any LangoAI software
• Redistribute, resell, sublicense, or make any LangoAI product available to third parties beyond your license terms
• Use any LangoAI product for any unlawful purpose
• Remove or alter any proprietary notices or labels

4. Platform-Specific Terms: iOS App (Apple App Store)

This section applies exclusively to users of the LangoAI iOS App downloaded from the Apple App Store.

4.1 Subscription Plan

*Local pricing may vary. The price displayed at time of purchase in your local App Store currency is the binding price.

4.2 Billing and Payment

• Payment is charged to your Apple ID account upon confirmation of purchase (or upon expiry of the free trial period).
• All transactions are processed by Apple via StoreKit. LangoAI does not store your payment information.
• Subscription management is handled by RevenueCat on our behalf.

4.3 Auto-Renewal

• Your subscription automatically renews unless you cancel at least 24 hours before the end of the current period.
• Your Apple ID account is charged within 24 hours prior to the end of the current period.

4.4 Free Trial

• New subscribers are eligible for a 7-day free trial.
• Your Apple ID account will not be charged during the trial period.
• If you do not cancel before the trial ends, your subscription converts to a paid subscription automatically.
• Only one free trial per Apple ID is permitted.

4.5 Cancellation

⚠️ Deleting the LangoAI app does NOT cancel your subscription.

To cancel your iOS subscription:

1. Open Settings on your iPhone or iPad
2. Tap your [Name] at the top
3. Tap Subscriptions
4. Tap LangoAI → Cancel Subscription

4.6 Refunds (iOS)

• iOS App purchases are non-refundable except as required by applicable law.
• For refund requests, contact Apple directly at https://reportaproblem.apple.com.
• LangoAI cannot process refunds for App Store purchases.

4.7 Restore Purchases

If you reinstalled the iOS App or switched devices, tap “Restore Purchases” within the App to restore your active subscription associated with your Apple ID at no additional charge.

4.8 Apple as Third-Party Beneficiary

• These Terms are between you and LangoAI, not Apple.
• Apple has no obligation to provide maintenance or support for the iOS App.
• Apple is a third-party beneficiary of these Terms and may enforce them against you.

5. Platform-Specific Terms: Adobe Exchange Plugins

This section applies to users of LangoAI for Adobe plugins (InDesign, Photoshop, Illustrator) distributed via Adobe Exchange.

5.1 License Type

LangoAI for Adobe is provided under a subscription-based commercial license. Free tier (if available) is subject to usage limits specified at the point of download. The license is granted per-user and is non-transferable.

5.2 Subscription Plans and Billing

• Subscription plans and pricing for Adobe plugins are listed on langoai.co and within the Adobe Exchange listing.
• Payments are processed by FastSpring, Adobe’s designated payment provider for paid Exchange listings, acting as the Merchant of Record.
• By purchasing a LangoAI for Adobe subscription, you agree to FastSpring’s Terms of Service and Privacy Policy.
• Subscriptions renew automatically unless cancelled before the renewal date.

5.3 Cancellation and Refunds (Adobe)

• You may cancel your Adobe plugin subscription at any time via your account on langoai.co or by contacting support@langoai.co.
• Refunds may be requested within 7 days of initial purchase for first-time subscribers who have not made excessive use of the Services.
• No refunds are issued for partial subscription periods or subsequent renewals unless required by applicable law.

5.4 Adobe Compliance

• LangoAI for Adobe plugins are developed and distributed in accordance with the Adobe Developer Terms of Use.
• The plugins do not modify, decompile, or reverse engineer any Adobe SDKs or APIs.
• We are not affiliated with, endorsed by, or a partner of Adobe Systems Incorporated. “Adobe”, “InDesign”, “Photoshop”, and “Illustrator” are trademarks of Adobe Inc.

5.5 EU Digital Services Act (DSA) — Trader Information

6. Platform-Specific Terms: WordPress Plugin

This section applies to users of the LangoAI WordPress Plugin installed on WordPress-powered websites.

6.1 License Type and Distribution

• The LangoAI WordPress Plugin core is distributed under the GNU General Public License v2.0 or later (GPLv2+), as required by WordPress.org guidelines.
• Premium features and API access are provided under a separate commercial subscription license, governed by these Terms.
• The GPLv2 license applies only to the plugin’s PHP codebase. All premium features, the LangoAI API, trademarks, brand assets, and proprietary backend remain exclusively owned by Kreatifart – Can Demirel.

6.2 API Key and Account

• Use of LangoAI’s translation features requires a valid API key obtained through a LangoAI account at langoai.co.
• Your API key is personal and non-transferable. You are responsible for keeping it confidential.
• You may not share, sell, or distribute your API key.
• We reserve the right to revoke API keys that are misused or shared without authorization.

6.3 Subscription Plans and Billing

• WordPress plugin subscription plans and pricing are available at langoai.co.
• Payments are processed by Paddle, acting as the Merchant of Record. By purchasing, you agree to Paddle’s Terms of Service and Privacy Policy.
• Subscriptions are billed monthly or annually and renew automatically unless cancelled before the renewal date.
• We reserve the right to change pricing with at least 30 days’ prior notice.

6.4 Cancellation and Refunds (WordPress)

• You may cancel your WordPress plugin subscription at any time via your account on langoai.co or by contacting support@langoai.co.
• Refunds may be requested within 7 days of initial purchase for first-time subscribers who have not made excessive API usage.
• No refunds are issued for subsequent billing cycles unless required by applicable law.

6.5 Site Owner Responsibility

• By using the LangoAI WordPress Plugin, you acknowledge that you are responsible for ensuring your use of the plugin complies with all applicable laws, including GDPR, if your website serves users in the EU.
• You are responsible for updating your own website’s Privacy Policy to reflect the use of LangoAI as a data processor (see our Privacy Policy for details).

7. AI-Powered Services and Third-Party Integrations

All LangoAI products use AI services to provide translation, OCR, and related features.

7.1 OpenAI

Your inputs (text, images, audio, documents) are processed by OpenAI’s API. By using LangoAI’s translation features, you consent to OpenAI’s processing of your content as described in their Privacy Policy and Terms of Use.

You must not submit to LangoAI (and thereby to OpenAI) any content that is confidential, personally identifiable (beyond what is necessary), or subject to export controls without ensuring compliance with applicable laws.

7.2 Other Integrations

See Section 5 of our Privacy Policy for a full list of third-party services integrated into LangoAI products (RevenueCat, Sentry, Supabase, Expo, FastSpring, Paddle).

8. User Content and Data

• You retain all ownership rights in the content you process through LangoAI.
• You grant us a limited, non-exclusive license to process your content solely to provide the Services.
• We do not retain translated content beyond the duration necessary to return results to you.
• You are solely responsible for ensuring that the content you submit complies with all applicable laws and does not infringe third-party rights.

9. Intellectual Property

All software, APIs, brand assets, trademarks (including “LangoAI” and associated logos), documentation, and proprietary components of all LangoAI products are the exclusive intellectual property of Kreatifart – Can Demirel.

The LangoAI software is licensed, not sold. Nothing in these Terms transfers any ownership rights to you.

References to third-party platforms (Apple, Adobe, WordPress) are for descriptive purposes only. All respective trademarks are property of their owners.

10. Privacy

Your privacy is important to us. Our Privacy Policy (incorporated herein by reference) describes how we collect, use, and protect your information across all LangoAI products.

11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Services will be uninterrupted, error-free, or secure
• AI translation output will be accurate, complete, or suitable for any specific purpose
• The Services will meet your particular requirements

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LANGOAI, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

Nothing in these Terms limits liability that cannot be excluded under applicable law (e.g., death or personal injury caused by our negligence, or statutory consumer rights).

13. Termination

• These Terms remain effective until terminated by either party.
• We may suspend or terminate your access immediately for material violation of these Terms.
• You may terminate at any time by ceasing use of the Services and (where applicable) cancelling your subscription.
• On termination: all licenses end, outstanding fees remain due, and provisions that by their nature should survive (including Sections 9, 10, 11, 12, 14) shall survive.

14. Governing Law and Disputes

These Terms are governed by the laws of Turkey. Any disputes shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey.

If you are a consumer located in the European Union, the mandatory consumer protection laws of your country of residence apply, and you may also bring proceedings in the courts of that country.

If you are located in the United Kingdom, UK consumer protection laws apply.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. For material changes, we will provide at least 30 days’ notice via:

• A notice in the App or plugin
• An email to registered users
• An update notice on langoai.co

Your continued use of the Services after the effective date of changes constitutes acceptance.

16. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and LangoAI regarding the Services.
• Severability: If any provision is found invalid, the remaining provisions remain in effect.
• Waiver: Failure to enforce any provision does not constitute a waiver.
• Assignment: You may not assign your rights or obligations under these Terms. We may assign ours in connection with a merger, acquisition, or sale of assets.
